"MDs' success Rate in Lawsuits Is Dropping"
"Physician's success rate in malpractice suits is falling, although, on the whole, they still win more cases than they lose, according to data from Jury Verdict Research in Horsham, PA. In 1997 - the most current year for which information is available - physicians won 63 percent of cases, compared to a high of 71 percent in 1996.
The percentage of cases in which punitive damages were awarded remained the same over the two-year period, at 2 percent, and the amount of punitive damages awarded per case continued a four-year decline, at $150,000 for 1997, compared to almost $400,000 in 1996."
